These Terms and Conditions govern the use of the ECR Marketplace (“Marketplace”), an online advertising platform operated by Equipe Classic Racing Ltd (“ECR Marketplace”, “we”, “us” or “our”).
By placing an advertisement on the Marketplace, you agree to be bound by these Terms and Conditions.
For the avoidance of doubt, ECR Marketplace acts solely as an advertising platform and is not a party to any transaction between buyers and sellers.
2. Advertising Service
2.1 ECR Marketplace provides advertising space for private individuals and businesses wishing to promote vehicles, parts, memorabilia, services and other related products.
2.2 ECR Marketplace does not buy, sell, broker, inspect, verify, store, transport, guarantee or endorse any item or service advertised on the Marketplace.
2.3 Any agreement, transaction, contract, payment, delivery or dispute arising from an advertisement is solely between the advertiser and the buyer or customer.
3. Advertisement Duration
3.1 All advertisements are published for a period of thirty (30) consecutive days from the date of publication.
3.2 At the end of the 30-day period, advertisements will automatically expire and be removed unless renewed by the advertiser.
3.3 ECR Marketplace reserves the right to remove advertisements at any time where we believe they breach these Terms and Conditions or are otherwise unsuitable for publication.
4. Advertiser Responsibilities
4.1 Advertisers must ensure that all information provided is accurate, truthful and not misleading.
4.2 Advertisers must have the legal right and authority to advertise and sell the item or provide the service being advertised.
4.3 Advertisers are solely responsible for the content of their advertisements, including photographs, descriptions, pricing, specifications and contact details.
4.4 Advertisers must comply with all applicable laws, regulations and consumer protection requirements.
4.5 Advertisers warrant that any photographs, text or other content submitted do not infringe the intellectual property rights of any third party.
4.6 Advertiser Declaration
By submitting an advertisement, the advertiser confirms and warrants that:
• They are the legal owner of the item being advertised or have the owner’s authority to advertise and sell it;
• All information contained within the advertisement is accurate and truthful to the best of their knowledge;
• Any photographs used in the advertisement accurately represent the item or service being offered;
• The advertisement does not knowingly omit any material information that could mislead a prospective buyer;
• They accept full responsibility for the content of the advertisement and any transaction arising from it.
4.7 Right to Verify Information
ECR Marketplace reserves the right to request additional information, documentation or proof of ownership before publishing or continuing to display an advertisement.
Failure to provide such information upon request may result in the advertisement being refused, suspended or removed without refund.
4.8 Right to Edit Advertisements
ECR Marketplace reserves the right to make minor amendments to advertisements for the purposes of correcting spelling, formatting, categorisation, image presentation or compliance with these Terms and Conditions.
Any such amendments shall not alter the fundamental nature of the advertisement.
5. Buyer Responsibility
5.1 Buyers are responsible for carrying out their own inspections, checks and due diligence before purchasing any item or engaging any service advertised on the Marketplace.
5.2 Buyers should independently verify the condition, authenticity, ownership, history, provenance and suitability of any item prior to purchase.
5.3 ECR Marketplace accepts no responsibility for any reliance placed upon information contained within advertisements.
6. Prohibited Advertisements
ECR Marketplace reserves the right to refuse, edit or remove any advertisement that:
• Contains false, misleading or inaccurate information;
• Is unlawful, fraudulent or deceptive;
• Infringes any intellectual property rights;
• Contains offensive, abusive or inappropriate material;
• Advertises prohibited or restricted goods or services;
• Is considered unsuitable for the ECR Marketplace community.
7. No Endorsement
7.1 Publication of an advertisement does not constitute endorsement, approval or recommendation by ECR Marketplace.
7.2 ECR Marketplace makes no representation regarding the quality, condition, ownership, authenticity, legality, safety or suitability of any item or service advertised.
8. Limitation of Liability
8.1 ECR Marketplace acts solely as a venue for advertisers to promote goods and services.
8.2 ECR Marketplace is not an auctioneer, broker, dealer, agent, reseller, escrow provider or intermediary in any transaction conducted between users of the Marketplace.
8.3 ECR Marketplace accepts no responsibility or liability whatsoever for:
• The accuracy of any advertisement;
• The condition, quality or legality of any item advertised;
• The performance or quality of any service advertised;
• Any transaction between advertisers and third parties;
• Payment disputes;
• Non-delivery of goods or services;
• Misrepresentation, fraud or deception by any advertiser or buyer;
• Any loss, damage, injury, expense or claim arising from the use of the Marketplace.
8.4 Buyers and sellers use the Marketplace entirely at their own risk.
8.5 To the fullest extent permitted by law, ECR Marketplace excludes all liability for any direct, indirect, incidental or consequential loss arising from the use of the Marketplace.
9. Advertising Fees and Refunds
9.1 Advertising fees are payable in advance.
9.2 Once an advertisement has been published, advertising fees are non-refundable except where required by law.
9.3 Removal of an advertisement due to a breach of these Terms and Conditions does not entitle the advertiser to a refund.
9.4 No Guarantee of Sale
The purchase of advertising space on ECR Marketplace does not guarantee enquiries, offers, sales, bookings, business opportunities or any particular level of response.
ECR Marketplace makes no representation regarding the effectiveness or performance of any advertisement.
10. Right to Remove Advertisements
ECR Marketplace reserves the right, at its sole discretion and without notice, to refuse, suspend, edit or remove any advertisement that breaches these Terms and Conditions or is considered unsuitable for publication.
11. Indemnity
Advertisers agree to indemnify and hold harmless ECR Marketplace, Equipe Classic Racing Ltd, its directors, employees, agents and representatives against any claims, losses, damages, costs, expenses or legal fees arising from:
• Their advertisement;
• Any sale or transaction connected with their advertisement;
• Any breach of these Terms and Conditions;
• Any claim brought by a third party relating to the advertised item or service.
12. Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales.
Any disputes arising in connection with these Terms and Conditions shall be subject to the exclusive jurisdiction of the courts of England and Wales.
